�ENEC Seneca Coal Company <br />May 30, 2014 <br />State of Colorado - Board of Land Commissioners <br />Department of Natural Resources <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />To Whom It May Concern; <br />Seneca Coal Company, (CDRMS Permit No. C -80 -005, approved September 23, 1981) intends to request <br />release of Phase III bond liability on the remaining 271.0 acres of its reclaimed lands at the Seneca II Mine. <br />A surety bond in the amount of $429,424 is currently in place of which $429,424, or all remaining bond, is <br />being requested for release. The remaining portion of the mine for which Phase III bond release is <br />requested was topsoiled and revegetated from the beginning of mining through the present in accordance <br />with the Colorado Division of Reclamation Mining and Safety (CDRMS) rules and regulations. <br />The Seneca II Mine is located approximately nine (9) miles southeast of Hayden, Colorado. The permit <br />boundary was reduced to its present area in 2010 upon the approval of Permit Revision 2 (PR2), which <br />coincided with the approval of the Peabody Sage Creek Mining permit that now occupies that part of the <br />Seneca II area that was removed. The specific area to which this Phase III bond release request applies <br />follows below: <br />TSN. R87W <br />Section 1: <br />Portions of SWNE, NESW, NWSE, and SWSE. All of SENE, NESE, and SESE <br />Section 12: <br />Portions of NENW, SENW, SWNE, and SENE. All of NWNE and NENE <br />TSN. R86W <br />Section 6: <br />Portions of L6 and L7 <br />Section 7: <br />Portions of L1 and L2 <br />All west of the 6h Principal Meridian, totaling approximately 386.5 acres. The USGS 7.5 Minute Quadrangle <br />Maps for Milner and Mt. Harris contain the described affected area. A copy of the bond release application <br />is available for public inspection at the Hayden Public Library, 201 E. Jefferson Avenue, Hayden, Colorado <br />81639. Written comments or objections or requests for public hearing or informal conference concerning <br />this application may be submitted to, and additional information obtained from, the Colorado Division of <br />Reclamation Mining and Safety, 1313 Sherman Street, Room 215, Denver, Colorado 80203 -2273, (303) <br />866 -3567.
