Box 483 <br />Paonia, CO 81428 <br />Re: Bowie No. 2 Mine (Permit No. C- 1996 -083) <br />Technical Revision No. 89 (TR- 89) <br />Relocation of Gob Pile #2 East and West Diversion Ditches <br />Preliminary Adequacy Review <br />Dear Mr. Bear: <br />The Division has reviewed the application submitted by JE Stover and Associates on behalf of <br />Bowie Resources, LLC (BRL) for Technical Revision No. 89 (TR -89) for the Bowie No. 2 Mine. The <br />revision proposes to relocate the East and West Diversion ditches further upslope of Gob Pile <br />#2. We have the following comments and questions regarding the application. <br />Rule 4.09.2(7) requires that surface runoff from the area above the fill be diverted away from <br />the fill into stabilized diversion channels, and that the diversion channels meet the <br />requirements of Rule 4.05.4. Rule 4.05.4 requires diversions to meet the requirements of Rule <br />4.05.3(1)(b) -(f). Rules 4.05.3(1)(d) and (e) require the diversion channels to be stable and be <br />constructed so as not to endanger property or public safety. The Division is concerned that the <br />proposed steepness of the cuts to the slopes above the ditch, particularly on the East Diversion <br />Ditch (as shown on proposed Map 15 -3 excerpt and photo, below) may result in the slope <br />above the ditch becoming unstable, potentially causing material from the slope sliding into and <br />blocking the diversion ditch. While some spalling of surficial material might be expected and <br />not be problematic, we are concerned about the stability of the entire hillside when the toe is <br />undercut. <br />The proposed cutslopes above the East Diversion ditch will be permanent, since the diversion ditch <br />is a permanent feature. As such, the final graded slopes are subject to the requirements of Rule <br />4.14.
