The Office of Surface Mining, Reclamation and <br />Enforcement (OSMRE), represented by Spencer Shumate and Jeremy Spangler, P.E., conducted <br />oversight of the inspection as a special focus for the 2013/2014 evaluation year. The focus of the <br />inspection was intended to evaluate coal mine waste banks, particularly compliance with <br />engineering and hydrology control requirements. The Division informed the operator (Basil <br />Bear) of the inspection by voicemail approximately 1 hour in advance. Mr. Bear was <br />underground in the Bowie No. 2 Mine, and was unable to participate. <br />Weather conditions during the inspection were sunny and warm; ground conditions were dry. <br />The inspection began at the East Mine, where the two permitted coal mine waste disposal areas <br />were constructed, and concluded at the Loadout. <br />PERMITTING UPDATE: <br />TR -58 Sediment Pond Removal: The Decision date has been extended to June 9, 2014. If the <br />Division approves this revision, a Stipulation will be attached requiring that a design for <br />reconstruction of East Roatcap Creek be approved before ponds W -1 and W -2 can be removed. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge <br />Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring <br />4.05.13; Surface Water Monitoring 4.05.13; Drainage Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />• At the East Mine, the West Ridge pond (Photo 1) and Ponds 1 (Photo 2), 3 and 4 (Photo 3) <br />were all dry. Division personnel did not inspect Pond 2. Pond inslopes were well- vegetated, <br />and spillways appeared to be in good working order. <br />• At the Loadout, the main sediment pond and the Coal Storage Area ponds were both dry. <br />• The "Farmers" irrigation ditch was flowing, entering the culvert pipe that carries it beneath <br />the Loadout. <br />Number of Partial Inspection this Fiscal Year: 12 <br />Number of Complete Inspections this Fiscal Year: 3 Page 2 of 9 <br />
