PERMIT#:M-1988-093 <br /> INSPECTOR'S INITIALS: TC1 <br /> INSPECTION DATE: May 20,2014 <br /> on file for this site. These tamarisk are cited as a problem on page 1 of this report. <br /> No standing water was observed in the pit. Ms. Sasser indicated the site Stormwater Management Plan is kept <br /> on file in the Canon City office. <br /> Current Stipulations: <br /> None. <br /> Records: <br /> • The previous inspection was conducted 6/10/2009. No problems were cited. <br /> • The permit anniversary date is March 3. The Operator is current with annual fees and reports. <br /> • A review of the power line structures agreement on file with the Division indicates: a) as it is with <br /> Centel, is probably out of date (the Division believes the line is no longer owned by Centel); and b) the <br /> agreement does not address "compensation for any damage to the structure", or for cases of utilities, <br /> state the mine operation "will have "no negative effect" on their utility". The deficient agreement is <br /> cited as a problem on page 1 of this report. A "no negative effect" clause should include an offset in <br /> order to keep the working face a safe distance from the power line. <br /> • Amendment 1 (AM01) approved in November 2004 facilitated a land swap, in conjunction with an <br /> acreage release (AR01), removing a 50 ft wide by 425 ft long strip of land on the south boundary, and <br /> adding an equivalent area on the northwest side of the permit. <br /> • The pre- and post-mine land use is rangeland. <br /> Bond: <br /> The current financial warranty is a $24,600.00 corporate surety. The bond has not been updated since the <br /> permit was issued in 1989. Attached is an updated bond estimate for $45,100, which includes current unit costs <br /> and the additional backfill material for the highwall. The Division will require a surety increase, to be sent <br /> under separate cover. <br /> Summary and Recommendations: <br /> 1. The Division has recommended to the Mined Land Reclamation Board (MLRB) the site be approved for <br /> Temporary Cessation(TC). The Operator will be notified of the Board's approval under separate cover. <br /> 2. The bond has not been updated since the permit was approved. The Division will notify the Operator of <br /> a surety increase in a separate letter. <br /> 3. Both the pit entrance sign and the Operator's representatives indicated the pit is referred to as the <br /> "Florence South Pit". To avoid future confusion with annual reports, etc. the Division recommends the <br /> Operator send a request separate from other correspondence to change the name. There is no fee for a <br /> name change to a pit. <br /> 4. The highwall is raveling and as the site is going into TC, additional work on the highwall may not occur <br /> for some time. The Division recommends the Operator perform some maintenance work of the highwall <br /> to facilitate stabilization and perhaps begin backfilling the highwall if the power line is not to be moved <br /> as suggested in the 11/14/1988 letter from Centel (enclosed). <br /> 5. The deficient structures agreement for the power line requires corrective action by July 15, 2014. <br /> 6. The repairs to the access road need to be completed and documentation of the repairs submitted <br /> to the Division by July 30,2014. <br /> 7. As the Division does not have a noxious weed control plan on file for this site, a Technical Revision is <br /> required to submit a Noxious Weed Control Plan and be must be received by July 30, 2014 <br /> (including the required $216 fee). <br /> Page 3 of 8 <br />
