OPERATORS <br /> SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br /> WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br /> Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br /> Reclamation Board will consider possible enforcement action. <br /> INSPECTION TOPIC: Availability Of Records <br /> PROBLEM/POSSIBLE VIOLATION: Problem: The Permanent Man-made Structures agreement with Centel for <br /> the power line running through the permit boundary is deficient and the Division has reason to believe is out of <br /> date. <br /> CORRECTIVE ACTIONS: The Operator, by 1uly15, 2014 must either: (a) provide a notarized agreement between <br /> the Operator and the owner of the power line, that the Operator is to provide compensation for any damage to <br /> the structure; or (b) where such an agreement cannot be reached, the Operator shall provide an appropriate <br /> engineering evaluation that demonstrates that such structure shall not be damaged by activities occurring at <br /> the mining operation; or. (c) as the structure is a utility, the Operator may supply a notarized letter, on utility <br /> letterhead, from the owner(s) of the power line that the mining and reclamation activities, as proposed, will <br /> have "no negative effect" on their utility. <br /> CORRECTIVE ACTION DUE DATE: 7/15/14 <br /> INSPECTION TOPIC: Roads <br /> PROBLEM/POSSIBLE VIOLATION: Problem: There is a significant collapse in the southern access ramp rising <br /> from the pit floor to the overburden/topsoil stockpile above the highwall that presents a potential safety <br /> hazard. <br /> CORRECTIVE ACTIONS: The Operator shall complete repairs to the access road in order to stabilize the road and <br /> provide documentation of these repairs to the Division by the due date. <br /> CORRECTIVE ACTION DUE DATE: 7/30/14 <br /> INSPECTION TOPIC: Revegetation <br /> PROBLEM/POSSIBLE VIOLATION: Problem: Tamarisk (salt cedar) trees are present within or have volunteered <br /> Pagel of 8 <br />
