BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />ORDER <br />IN THE MATTER OF THE PETITION FOR DECLARATORY ORDER OF <br />GOLD EAGLE MINING, INC., Permit No. M -1977 -248 <br />THIS MATTER came before the Mined Land Reclamation Board ( "Board ") on <br />May 21, 2014 in Denver, Colorado to consider the agreement between the Colorado <br />Division of Reclamation, Mining, and Safety ( "Division "), Gold Eagle Mining, Inc. <br />( "Operator "), and Information Network for Responsible Mining ( "INFORM"). <br />The Board, having considered the Stipulated Agreement between Division of <br />Reclamation, Mining, and Safety, Gold Eagle Mining, Inc., and INFORM regarding <br />Extension of Reclamation Deadline ("Agreement," Attachment 1), states that it <br />agrees with the provisions of the Agreement, and finds and orders the following: <br />1. The Operator holds a 112(d) -1 reclamation permit for a uranium and <br />vanadium mine located in Section 21, Township 46 North, Range 17 West, <br />N.M.P.M, in Montrose County, Colorado, permit number M- 1977 -248. The mine is <br />known as the C -JD -5 Mine. <br />2. On May 13, 2014, the Division received a Petition for Declaratory <br />Order from the Operator ( "Petition"). The Petition requested the Board waive the <br />May 31, 2014 deadline for the Operator to complete reclamation at the mine. <br />3. On May 15, 2014, the Division received INFORM's Petition to <br />Intervene in the Board hearings regarding the Operator's Petition. INFORM's <br />Petition to Intervene also requested certain relief regarding the Operator's <br />requested extension of the reclamation deadline. <br />4. INFORM's Petition to Intervene is granted. <br />5. The Operator's Petition for Declaratory Order is granted with the <br />following requirements: <br />a. The Operator must submit to the U.S. Department of Energy a <br />reclamation plan for the mine in accordance with the lease stipulations on or <br />before June 30, 2014, and the Operator must provide the Division and <br />INFORM copies of all documents submitted to U.S. Department of Energy <br />regarding the reclamation plan for the mine; <br />
