BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />IN THE MATTER OF GOLD EAGLE MINING, INC., PERMIT NOS. M- 1977 -248, M -1977 -297, M- <br />1978 -311, AND M- 1978 -342 <br />STIPULATED AGREEMENT BETWEEN DIVISION OF RECLAMATION, MINING, AND <br />SAFETY, GOLD EAGLE MINING, INC., AND INFORMM REGARDING EXTENSION OF <br />RECLAMATION DEADLINE <br />THIS AGREEMENT ( "Agreement ") is made and entered into by and between the Colorado <br />Division of Reclamation, Mining and Safety ("Division "), GoId Eagle Mining, Inc. ( "Gold Eagle "), and <br />Information Network for Responsible Mining ( "INFORM ") (jointly as "Parties "). The Parties submit this <br />agreement for consideration by the Mined Land Reclamation Board (`Board "). In support of their <br />Agreement, the Parties state the following: <br />Recitals <br />A. Gold Eagle holds three 110(1) mining permits for uranium mines located in San Miguel <br />County, permit numbers M- 1977 -297, M- 1978 -31 i, and M -1978 -342, and one 112 permit for a uranium <br />mine located in Montrose County, permit number M -1977 -248. Gold Eagle leases all four mine sites <br />from the U.S. Department of Energy ( "DOE "). <br />B. Both DOE and the Division must review and approve reclamation plans and final <br />reclamation for Gold Eagle's mines. <br />C. In May of 2013, the Division and Gold Eagle agreed that Gold Eagle would submit and <br />obtain approval of revised reclamation plans for the mines and complete reclamation at all four mines on <br />or before May 31, 2014. <br />D. In August of 2013, Gold Eagle submitted revised reclamation plans to the Division and <br />DOE for review and approval. <br />E. By letter dated September 26, 2013, DOE stated that the technical revisions did not meet <br />certain lease requirements and requested that Gold Eagle "submit a reclamation plan for each operation in <br />accordance with these lease stipulations." DOE's letter also stated that the federal District Court "in its <br />Order of February 27, 2012, has enjoined DOE from approving any activities (including exploration, <br />drilling, mining, and reclamation)" for the mines. A copy of DOE's letter is attached as Exhibit A. <br />F. In December of 2013, the Division approved revised reclamation plans for Gold Eagle's <br />mines. <br />G. On May 13, 2014, the Division received Gold Eagle's Petition for Declaratory Order <br />( "Petition "). The Petition requested the Board waive the May 31, 2014 deadline due to the federal <br />District Court injunction. A copy of the Petition is attached as Exhibit B. <br />Page 1 of 2 <br />
