This version contains a <br />pleading /exhibit deadline of June 6. As indicated in a previous e-mail, the Board often likes to utilize such <br />Hearing Orders to ensure an orderly hearing process. This proposed Order seeks to create a Pleading and <br />Documents exchange date and establishes a presentation order with allocations of time. Please review this draft <br />in advance of tomorrow's meeting so that we can discuss the hearing process, presentation procedures, and <br />exchange of written materials /information. If all Parties agree we can sign this agreement to establish a hearing <br />order. <br />understand not only are we convening a conference call tomorrow, but there is interest in an in- person meeting <br />next week. In an effort to encourage discussion when the Parties are not "time- crunched" preparing for the June <br />18 hearing I would once again suggest that we all consider whether a July hearing makes more sense so that all <br />Parties have ample time to either prepare for this hearing or discuss possible resolutions. I am not sure there is <br />sufficient time to do both simultaneously before June 6. <br />The hearing is currently set for June 18. Hard copies of all materials (Pleadings and Exhibits) are gathered and <br />sent to the members of the Board by mail on June 6. Therefore, the Parties have just one week from tomorrow to <br />prepare for this hearing - -which is not a lot of time. In addition, efforts /resources now being utilized to answer <br />many of K2T's questions will have to be reassigned for hearing preparation. <br />Again, David and I are looking forward to the discussion at tomorrow's meeting. <br />Jeff <br />Jeff M.
