Box 483 <br />Paonia, CO 81428 <br />Re: Bowie No. 2 Mine (Permit No. C- 1996 -083) <br />Permit Revision No. 14 (PR- 14) <br />Spruce Stomp Expansion — Federal Coal Lease No. COC75916 <br />Preliminary Adequacy Review - Groundwater <br />Dear Mr. Bear: <br />The Division has reviewed the application submitted by JE Stover and Associates on behalf of <br />Bowie Resources, LLC (BRL) for Permit Revision No. 14 (PR -14) for the Bowie No. 2 Mine. The <br />revision proposes to incorporate the Spruce Stomp Lease and associated mine plan into the <br />currently approved permit application package. We transmitted adequacy comments to you on <br />May 19, 2014, noting that the review of groundwater information had not yet been completed. <br />Having completed the review of groundwater information, we have the following comments <br />and questions regarding the application. To avoid confusion when tracking the resolution of <br />these comments, they are numbered to follow our May 19, 2014 letter. <br />General Comments: <br />DRMS Interoffice Memoranda related to previous Permit Revisions provide a narrative as to the <br />development of the groundwater monitoring program at the Bowie 2 mine. <br />Briefly: <br />The HydroGeo report of September 2008, which was incorporated into Volume III, Exhibit 3 of the PAP <br />with the approval of PR -10, analyzed water quality data from the B -seam and from the strata above the <br />B -seam. Although there remain concerns with both the quality and quantity of data on which the <br />analysis was based - which were acknowledged in the report - the Division accepted the conclusions of <br />the report that: (i) the data show little North -South variation in water quality within the permit area; <br />and (ii) there is no reason to expect the water quality to change beyond the permit boundary to the <br />North. <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us I <br />John W.
