Step 3 required that the operator cease discharging through the damaged spillway of Pond <br />P9. A phone conversation between Brock Bowles and Stan Muhr on April 30, 2014 indicated that the flow had <br />already been re- routed and was no longer going through the damaged spillway. <br />Site conditions were warm and clear. I walked the site from the two mine discharge pipes to the old Refuse Pile <br />pond. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4, Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />Water has been re- routed from the damaged primary spillway of Pond P9 through pipes that divert the <br />flow around Pond P9 and through the `China hat' structure where the water is routed into the ditch that was <br />constructed last summer. All flow is directed into a ditch that leads to the old Refuse Pile pond. See attached <br />photos. No off -site discharge was noted and there was no flow in the damaged Pond P9 spillway. This satisfies <br />abatement step 3. <br />Minrec submitted TR -28 on May 15, 2014 with a revised design for the spillway as required by Abatement Step 1. <br />The Division is in the process of reviewing TR28. <br />Abatement Steps 1 and 3 are abated.
