Colorado 80203 <br />May 21, 2014 <br />Mr. Mark Johnson <br />Bestway Concrete Company <br />301 Centennial Dr. <br />Milliken, CO 80543 <br />Re: The Shores, Permit M- 1998 -013, Amendment Approval, Revision AM02 <br />Mr. Johnson: <br />On May 21, 2014 the Division of Reclamation, Mining and Safety approved the Amendment application submitted to <br />the Division on January 10, 2014, addressing the following: <br />AM02 will add 60.3 acres to the total permitted area <br />The terms of the Amendment 2 approved by the Division are hereby incorporated into Permit M -1998 -013. All other <br />conditions and requirements of Permit M- 1998 -013 remain in full force and effect. <br />The new estimated liability amount of $1,765,070.00 exceeds the $1,607,800.00 performance bond currently held. If <br />you have not already done so, please submit additional bond in the amount of $157,270.00 within 60 days of the date <br />of this notification. The revision will not be final until the bond is approved by the Division. <br />Also note that groundwater cannot be exposed on any of the amended area until the bond has been appropriately <br />modified to include either backfilling, or lining the additional area to S.E.O. standards to isolate it from the <br />surrounding aquifer. <br />As a condition of this approval, Bestway Concrete is also now required to submit for DRMS approval a groundwater <br />mitigation plan, with appropriate monitoring plan and trigger levels based on monthly data collected from the recently <br />installed monitoring wells, no later than June 30, 2015. <br />If you have any questions, please contact me. <br />Sincerely, <br />Eric C.
