The violation was identified during a routine complete quarterly <br />inspection on April 23, 2014. NOV CV- 2014 -001 was issued from the DRMS office on April 30, 2014 and received by <br />J. E. Stover Et Associates (contractor to the operator MINREC, Inc.) on May 8, 2014. <br />The notice of violation was issued for: <br />• Failure to maintain Pond 9 discharge structure to minimize impacts to hydrological balance as required <br />by Rules 4.05.7 and 4.05.6(2), <br />• Failure to properly maintain spillways and emergency spillways from a treatment facility as required by <br />Rules 4.05.6(4) and 4.05.9(2). <br />The portion of the operation to which the violation applies is the area between Pond 9 and NPDES outfall 001 (see <br />attached Drawing D -2 -5). <br />Pursuant to Rule 5.04.3(2), 1 am requesting that you determine the amount of the proposed civil penalty for the <br />violation. The notice of civil penalty is due on or before May 30, 2014. To assist you in your research for <br />determining the civil penalty, I offer the following comments in addition to the NOV and the inspection report <br />(attached): <br />• DRMS has not received comments from the operator as of the writing of this request <br />• Pertaining to History - <br />o No violations have been issued to the North Thompson Creek Mine in the last 12 months <br />• Pertaining to Seriousness <br />• There was no off -site damage resulting from the NOV <br />• No surface damage could be seen during the April 23, 2014 inspection <br />• This discharge of water into the 18" CMP was not noted during the November 11, 2014 <br />inspection, when the site was last accessible <br />• The discharge water into the 18" CMP has the potential to saturate the soil of the impoundment <br />and hillside resulting in the failure of the impoundment <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
