COLORADO
Division of Reclamation,
Mining and Safety
Department of Natural Resources
1313 Sherman Street, Room 215
Denver, CO 80203
May 21, 2014
To: Dan Hernandez
From: Brock Bowles
RE: North Thompson Creek (C- 1981 -025)
Notice of Violation No. CV- 2014 -001
Request for Assessment of Civil Penalty
I issued NOV CV- 2014 -001 on April 30, 2014. The violation was identified during a routine complete quarterly
inspection on April 23, 2014. NOV CV- 2014 -001 was issued from the DRMS office on April 30, 2014 and received by
J. E. Stover Et Associates (contractor to the operator MINREC, Inc.) on May 8, 2014.
The notice of violation was issued for:
• Failure to maintain Pond 9 discharge structure to minimize impacts to hydrological balance as required
by Rules 4.05.7 and 4.05.6(2),
• Failure to properly maintain spillways and emergency spillways from a treatment facility as required by
Rules 4.05.6(4) and 4.05.9(2).
The portion of the operation to which the violation applies is the area between Pond 9 and NPDES outfall 001 (see
attached Drawing D -2 -5).
Pursuant to Rule 5.04.3(2), 1 am requesting that you determine the amount of the proposed civil penalty for the
violation. The notice of civil penalty is due on or before May 30, 2014. To assist you in your research for
determining the civil penalty, I offer the following comments in addition to the NOV and the inspection report
(attached):
• DRMS has not received comments from the operator as of the writing of this request
• Pertaining to History -
o No violations have been issued to the North Thompson Creek Mine in the last 12 months
• Pertaining to Seriousness
• There was no off -site damage resulting from the NOV
• No surface damage could be seen during the April 23, 2014 inspection
• This discharge of water into the 18" CMP was not noted during the November 11, 2014
inspection, when the site was last accessible
• The discharge water into the 18" CMP has the potential to saturate the soil of the impoundment
and hillside resulting in the failure of the impoundment
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us
John W.
