2.05.6(6)
Springs could be damaged by subsidence cracks in the impervious layer
below the springs which would cause them to drain to the formation below. It
may be possible to repair a spring that is affected by a subsidence crack.
First the flow interrupting crack would have to be located. Then an
impervious liner would be installed to seal the crack. Then the spring would
be developed with the use of perforated pipe and pervious gravel.
The Division of Water Resources recognizes beneficial use as the use for
which a water right is claimed such as irrigation, domestic, stock watering,
industrial etc. The District Court determines through the ruling of the Water
Referee that water has been appropriated and applied to beneficial use. The
Operator's private springs in the permit and adjacent area, J & M Springs
and Pipelines Nos. 1 through 5 and Bowie Spring S -3 have been put to
beneficial use. The USDA -FS has eight decreed water rights within the
permit boundary and eight decreed water rights in the adjacent area.
Disruption of perched water bearing zones will occur due to mining where the
water bearing zones lie in the immediate vicinity of the mine roof. Because
of the nature of this groundwater, this does not constitute any affect on
groundwater resources. The local perched water - bearing zones would be
disrupted, but are limited in extent and are not put to beneficial use. No
affect on area water utilization is anticipated.
Hubbard Creek road, Terror Creek road, Stevens Gulch road and numerous
jeep trails in the permit and adjacent area could be damaged by a
subsidence crack causing a hazard to foot or vehicle traffic. Repairs to the
roads and trails will be performed by appropriate earth - moving equipment.
Typically, roads and trails are maintained on an annual basis, as required, to
access environmental resources monitoring stations. Persons using trails
will be notified of any hazards. Those persons are typically the Operator's
employees, hunters and monitoring personnel. Tenor Creek Road is outside
of the projected angle of draw so no damage is predicted.
PR -13 2.05-141- 02/13
