F DNR <br />CO% <br />May 19, 2014 <br />COLORADO <br />Division of Reclamation, <br />Mining and Safety <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Mr. Jason Burkey <br />Oldcastle SW Group, Inc. <br />Dba United Companies of Mesa County <br />2273 River Road <br />Grand Junction, CO 81502 <br />Re: Gypsum Ranch Pit, Permit M- 1998 -014 Succession of Operators Approval, Revision <br />SO -3, Stipulation 01 Complied With <br />Dear Jason Burkey: <br />On February 25, 2014, the Division of Reclamation, Mining and Safety approved with the following <br />stipulation, the succession of operators from Lafarge West, Inc. to Oldcastle SW Group, Inc. dba United <br />Companies of Mesa County for this operation. Oldcastle SW Group, Inc.dba United Companies of Mesa <br />County is now the permitted operator of the Gypsum Ranch Pit, and as such, is responsible for all <br />provisions in M- 1998 -014, as well as those specified in the Rules and Regulations. Lafarge West, Inc. is <br />relieved of all responsibilities concerning this operation. <br />Stipulation No. 1 <br />Oldcastle SW Group, Inc. dba United Companies of Mesa County to submit all required properly executed <br />structure damage waiver agreements within 180 days of this approval of Succession of Operator. If waivers <br />cannot be obtained within 180 days, the operator shall submit a geotechnical evaluation including <br />engineering stability analysis as required per CRS 34- 32.5 - 116(4)(1) and Rule 6.5. <br />On May 9, 2014 the Division received the properly executed Structure Damage Waiver Agreement from the <br />landowners Schmidt Ranch Partnership, LLP and Gypsum Ranch Co.
