The subject <br />of the Request for Hearing is the modification of a Notice of Violation (the "Modified NOV ") <br />issued to Energy Fuels Coal Inc. ( "EFCI ") regarding a monitor well (MW -NW) located at the <br />Southfield Mine. EFCI has completed all the abatement requirements as set forth in the Modified <br />NOV. For ease of reference, EFCI will use the reference to K2T and South Central that is used in <br />the Division communications: the " Vento Trust Group ". <br />The items (the "Items ") listed below are set forth in a letter addressed to the Division of Mining, <br />Reclamation and Safety from K2T dated April 23, 2014. <br />The Division has suggested that the Parties (EFCI, the Vento Trust Group and the Division) <br />participate in a pre - hearing informal meeting (the "Settlement Conference ") to determine whether <br />settlement of the matter can be reached prior to the scheduled Board Hearing on June 18, 2014 (the <br />"Hearing "). <br />While many of the Items appear to be seeking a response from the Division and several of the Items <br />are outside the scope of the Hearing that has been requested, the Vento Trust Group have <br />conditioned their willingness to participate in the Settlement Conference on receipt of written <br />responses by EFCI to the Items. <br />EFCI is willing to provide the written responses to all the Items, whether they relate to the Hearing <br />or not. However, the statements in theses responses are made in the context of a settlement process <br />and EFCI is not waiving any evidentiary or other procedural rights that may be available to it with <br />
