Rule 2.03.6 — Right of Entry and Operation Information
5. Pages 2.03 -8 and 2.03 -15 reference Federal Coal Lease COC75916 providing right of entry to
mine the coal in the proposed PR -14 expansion area. It is the Division's understanding that
this lease has not yet been granted to BRL. Please provide updated information on the
status of Lease COC75916 approval.
Rule 2.04.4 — Cultural and Historic Resource Information
6. Page 2.04 -12 acknowledges that the Class III study conducted in the Spruce Stomp area did
not evaluate the effects of surface activities on the identified sites that are eligible for listing
on the National Register of Historic Places. Prior to any surface disturbance in the Spruce
Stomp expansion area, BRL will need to evaluate the effects of that disturbance on any of
the sites listed as eligible for listing on the National Register of Historic Places.
7. The pagination of revised pages 2.04 -12 and 2.04 -13 is inconsistent with the currently
approved permit application package. Page 2.04 -12 of the currently approved application
starts with Section 2.04.5, General Description of Hydrology and Geology. Please revise the
proposed page numbering of revised pages 2.04 -12 and 2.04 -13 to be consistent with the
currently approved page 2.04 -12 so that the General Description of Hydrology and
Geology required by Rule 2.04.5 is retained.
Rule 2.04.6 —Geology Description
8. The information presented on Maps 08 and 08A, Geologic Cross Sections, does not appear
to have been updated with the PR -14 submittal (excepting the permit boundary, which was
updated). Please update Maps 08 and 08A to include stratigraphy and structure
information for the PR -14 expansion area, as required by Rules 2.04.6(1) and (3).
Rule 2.04.7 — Hydrology Description
Rule 2.04.7(1) — Ground Water Information
The Division has not yet completed its review of the application materials addressing baseline
ground water information. Comments on ground water will be forwarded to BRL at a later
date.
Rule 2.04.7(2) — Surface Water Information
9. Currently approved page 2.04 -12 indicates that the West Fork of Terror Creek is north of the
western permit area; the West Fork of Terror Creek will be within the permit and affected
areas with the PR -14 expansion. Please update page 2.04 -12 to reflect the location of
