Filbert Ct. <br />Centennial, CO 80121 <br />RE: Notice of Intent to Conduct Prospecting Application; Capital Prize Mine; DRMS File No. <br />P- 2014 -005; Second Notice of Deficiencies <br />Dear Mr. Tulk, <br />On March 25, 2014, the Division of Reclamation, Mining and Safety (Division) received the <br />Notice of Intent (NOI) to Conduct Prospecting Application for Capital Prize Mine, File No. <br />P- 2014 -005. Our review indicates the NOI application contains deficiencies as defined by Rule <br />5.1.3 of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for <br />Hard Rock, Metal, and Designated Mining Operations. The Division requires the information <br />described below before we can approve the NOI application. <br />1. In the Applicant's letter dated May 19, 2014, it was stated that any increase in the discharge <br />of mine water resulting from clearing the blockages in the main tunnel will be routed to a <br />north drift. Please provide additional detail describing how the water will be routed to a north <br />drift. In addition, please provide the Division with any available volume calculation to <br />demonstrate that this method is adequate to handle an increased volume of mine water <br />discharge. Also, please indicate if routing water to the north drift will result in a discharge to <br />the surface at some other undefined point. <br />Be advised that if these items have not been addressed within 60 days of the date of this letter <br />(June 23, 2014), the Division may terminate the NOI application in accordance with Rule <br />5.1.3(c) of the Hard Rock Rules. <br />Please remember to designate as appropriate those materials in the application that you desire to <br />be made confidential versus those to be made public. <br />-� <br />of Ow� <br />�/,/0 <br />`d� <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us <br />John W.
