The technical revision was received on April 8, 2014 and
deemed complete on April 16, 2014. The Division has reviewed the submittal and has the
following questions and comments.
Per Rule 4.05.2(2) sediment ponds shall be maintained until the disturbed area cover
ceases to contribute a sediment load above natural conditions and "the quality of
untreated drainage from the disturbed area meets the [applicable] State and Federal water
quality standard requirements... for receiving streams." Stover and Associates has
provided the first part of this (the sediment load portion), but has not addressed the
portion of the rule regarding water quality requirements. Please compare water quality
requirements in receiving waters to measured or predicted water quality in runoff from
the areas in question (without treatment from the pond or other sediment control
practice). The water quality requirements that are relevant are those of the Water Quality
Control Commission (within the Colorado Department of Public Health and
Environment), namely Regulation No. 37, Classifications of Numeric Standards for
Lower Colorado River Basin.
If you have questions or need additional information, please contact me.
1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us
John W.
