COLORADO <br />A%F Division of Reclamation, <br />Mining and Safety <br />Departmem of Natural ReSOUTCeS <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Louis Head <br />New Elk Coal Company, LLC <br />12250 Hwy 12 <br />Weston, CO 81019 <br />May 13, 2014 <br />Re: New Elk Mine (Permit No. C- 1981 -012) <br />Production Resumption <br />Dear Mr. Head, <br />Thank you for letter of May 6, 2014, informing the Division of the planned resumption of mining <br />at the New Elk Mine from May 14, 2014. <br />It is noted that: <br />• Mining will be in the Bates East section of the Blue Seam <br />• In -seam mining will be employed <br />• Coal will not be washed or otherwise processed on site <br />• Minimal waste should be produced. Waste is currently permitted to be stored at the <br />Temporary Development Waste Disposal Area (Temporary DWDA) near the soil <br />stockpiles. The Division anticipates a Technical Revision concerning the disposal of <br />waste, but until such a revision is approved any waste produced should be stored at the <br />Temporary DWDA <br />• NECC anticipates raw coal production rates of 15,000 tons /month, and a raw coal <br />stockpile volume of 9000 tons <br />The status of the New Elk Mine has been changed from "Temporary Cessation" to "Active" with <br />immediate effect.
