<br />Dear Ms. Ramsey;
<br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34,
<br />Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on May 12, 2014 an application
<br />(TR -36) to revise coal mining operations at the Williams Fork Mines was considered complete for the
<br />purposes of filing. The revision was submitted by Moffat County Mining, LLC. All review and comment
<br />periods as provided in the Act and the Regulations initiate from this date of filing.
<br />This Technical Revision provides permit updates required for Permit Renewal No. 6 (RN -6) and Midterm
<br />Review No. 6 (MT -6). Mining operations ceased at the site in 1995 and the site was placed in Temporary
<br />Cessation Status in 2001. The site was removed from Temporary Cessation status due to several site
<br />reclamation activities that occurred between 2006 and 2010. On July 9, 2013 the site was placed back into
<br />Temporary Cessation Status in accordance with Rule 4.30.1. The Permit Renewal application and this
<br />Technical Revision do not add additional lands to the permit area. Enclosed are the currently approved
<br />relevant sections of 2.04, 2.05, 4.0 and Exhibit 15a of the Williams Fork Mines permit which contain the
<br />Fish and Wildlife baseline information and protection plan as well as the assessment of threatened and
<br />endangered species. Also enclosed are the proposed revised changes to portions of some of these sections
<br />submitted with Technical Revision No. 36. Also included is the latest biological assessment and opinion
<br />completed by the Office of Surface Mining and the US Fish and Wildlife Service during the review of
<br />Permit Renewal application No. 4 (RN -4).
<br />Please advise if a section 7 consultation with the USFWS is necessary for Permit Renewal No. 6. If so, the
<br />Division would request this process be initiated as soon as possible.
<br />The underground coal mining operation is on land located approximately 7 miles Southwest of
<br />Craig, Colorado. The permit area is further described as follows:
<br />All or portions of Sections 4, 5, 6 and 8, T5N, R91 W; part of Section 1, T5N, R92W; and Sections
<br />17, 19, 20, 21, 28, 29, 30, 31, 32 and 33, T6N, R91 W; portions of Sections 25, 26, 35 and 36, T6N,
<br />R92W; 6th Prime Meridian.
