Diversion Ditches <br />Preliminary Adequacy Review — Supplemental Information <br />Dear Mr. Bear: <br />On May 2, 2014, the Division transmitted its preliminary adequacy review comments on the <br />application submitted by JE Stover and Associates on behalf of Bowie Resources, LLC (BRL) for <br />Technical Revision No. 87 (TR -87) for the Bowie No. 2 Mine. The revision proposes to expand <br />Pond D and relocate the East and West Diversion ditches of Gob Pile #2. <br />Item 2 of our letter, reiterated below, noted that we had received comments from History <br />Colorado regarding the application. <br />2. The Division received comments from History Colorado, which were forwarded to you on April <br />22, 2014. History Colorado stated that the proposed expansion of Pond D and subsequent <br />demolition of the King Mine Coal Sales building would have an adverse effect on the National <br />Register - eligible King Mine site. BRL has indicated that a mitigation plan was approved in <br />November of 1995, with the documentation provided in Volume VI of the currently approved <br />permit application package. The Division is currently working with History Colorado to <br />determine whether any additional action or information will be required from BRL, and will <br />notify you as soon as any determination has been made. <br />We have since discussed the proposal further with History Colorado.
