I, Jared Ebert of the Colorado Division of Reclamation, Mining and Safety conducted the inspection. Mr. <br />Billy Nicholson accompanied me during the first few hours of the inspection and Mr. Graham Roberts <br />accompanied me during the remainder of the inspection. The weather was clear and windy during most of the <br />inspection becoming partly cloudy and windy at the end of the inspection. <br />BACKFILL and GRADING — Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.143; Stabilization of Rills and Gullies 4.14.6: <br />The Operator was actively backfilling behind the pit excavation with the draglines and the truck haul fleet. <br />EXCESS SPOIL and DEVELOPMENT WASTE — Rule 4.09 <br />Placement, Drainage Control; Surface Stabilization: <br />Horse Gulch Fill was observed. The face of the fill appeared stable and the minor rills that were observed on the <br />upper face has been repaired and appear stable. The north and south side drains were clear of snow and appeared <br />functional.
