With the mining pit top of bank setback a minimum of 50 feet or three (3) times the <br />adjacent pit depth, whichever is greatest, from permanent man -made structures, the <br />applicant believes that we have complied with the provisions of Rule 6.4.19 and we do <br />not believe that mining and reclamation activities will adversely affect the stability of any <br />significant, valuable and permanent man -made structure not owned by the applicant. <br />As stated in the DRMS Adequacy Review comments from Blue Earth Solutions dated <br />April 7, 2014, the Applicant has been discussing the proposed mining and reclamation <br />operation with owners of adjacent utility structures.
