An application for TR -17 was received on August 30, 2013. This revision was submitted in <br />response to Notice of Violation CV- 2013 -005, and addressed issues associated with as -built <br />plans for the Carbon Junction Permanent Diversion Channel and necessary reestablishment of <br />the Upper Carbon Junction drainage. TR -17 was approved on October 29, 2013 and formally <br />issued on November 12, 2013. Channel reestablishment was accomplished in the week that <br />followed, and the violation was terminated on November 19, 2013. <br />Permit Renewal No. 4 (RN -04) <br />On October 31, 2012, the Division informed Oakridge Energy, Inc. that the five -year term for the <br />Carbon Junction Mine would expire on July 31, 2013. On January 23, 2013, the Division <br />received Oakridge's application (RN -04) to renew the permit for a fifth five -year term. The <br />application was initially deemed incomplete on January 31, 2013. The proposed public notice <br />and Certificate of Liability Insurance were updated, and the application was deemed complete on <br />February 8, 2013. <br />The Division provided notice of the application to Federal (OSM, NRCS, and USACOE); State <br />(APCD, WQCD, DOW, DWR, and SHPO); and Local (SWCD, La Plata County, and City of <br />Durango) agencies. The applicant's public notice was published in The Durango Herald on <br />February 13, 20, and 27 and March 6, 2013. Proof of Publication was provided to the Division <br />on March 15, 2013. No comments or objections to the permit renewal were received from the <br />general public. The Office of the State Engineer (Division of Water Resources) submitted <br />comments regarding groundwater and monitoring wells within the permit area in a letter dated <br />April 11, 2013. These comments were forwarded to the applicant. <br />An adequacy response package was received on August 30, 2013. The Division issued a second <br />adequacy review on December 12, 2013, to which a response was submitted on March 19, 2014. <br />A third adequacy review was issued on April 25, 2014, listing the few remaining issues to be <br />addressed under RN -04. The letter also identified additional items that are to be formally <br />addressed in a pending Permit Revision (PR -01) application. All RN -4 issues were satisfactorily <br />resolved with the response received on April 29, 2014. <br />Description of the Environment <br />The Carbon Junction Mine is located in southwestern Colorado, approximately 2 miles southeast <br />of the town of Durango. Elevation of the area ranges from approximately 6800 feet to 7400 feet. <br />The mine is located in the upper drainage basin of Carbon Junction Canyon. This ephemeral <br />tributary to the Animas River has a drainage area of 0.8 square miles. This stream channel has a <br />steep gradient and is in a steep - walled valley along much of its length. <br />Geology <br />The permit application describes the geology of the permit area and adjacent area (permit <br />application Sections 2.04.5, 2.04.6; Table 4 -1; Map 4 -2; and Appendix 4 -2). The permit area is <br />located on the northern rim of the San Juan structural basin in southwestern Colorado.
