Therefore, exposure of <br />ground water must not occur during or after mining operations. <br />• The proposed operation may have potential impact on existing water rights near the project <br />Location. The proposed project shall not alter or impact the historic operation of existing water <br />rights. <br />• The applicant has not identified any proposed use of water at the permit site. If water will be <br />used for any purpose at this site, the applicant will need to document that the water was <br />obtained from a legal source, or the water was diverted in priority under a water right decreed <br />for such industrial use. <br />COMMENTS: The application seeks an amendment to update the mining and reclamation plans, update <br />the post- mining land use from agricultural to wildlife habitat, and clarify the mining boundary for an <br />existing surface mining operation on 9.99 permitted acres near Lyons, Colorado. The primary commodity <br />to be mined at the site is sandstone. <br />The South Ledge Ditch (WDID 0500520) crosses the eastern portion of the mined area. The proposed <br />mining operation is not expected to directly affect the South Ledge Ditch. <br />If stormwater runoff is intercepted by this mining operation and is not diverted or captured in priority, it <br />must be released to the stream system within 72 hours, which may require a discharge permit from <br />CDPHE -WQCD.
