(EFCI) requests approval of Technical Revision NoA l (TR -41) to <br />relocate the vegetation Reference Area (RA) at EFCI's Loadout site, the Loadout site being one mile west <br />of Florence, Colorado. At some point in time, the former vegetation RA which was located east of and <br />adjacent to the eastern boundary of the east Loadout site, was totally disturbed by unknown persons who <br />removed gravel from the former RA. The vegetation was removed from the former RA prior to the gravel <br />excavation and reference to that vegetation RA was lost. <br />Accordingly, EFCI requests approval to relocate the vegetation RA to an undisturbed area in the <br />northwest corner of the East Loadout site (east of and adjacent to County Road 79). A map, "Figure 1, <br />Loadout Area Vegetation Reference Area" map depicting the proposed relocation of the RA is enclosed <br />for review and file. The size of the relocated RA is 1.01 acre and the boundaries of the RA are marked <br />with colored wire pin plastic flagging. Following the Division's approval of the RA, the plastic flagging <br />will be replaced with permanent markers. <br />At the recommendation of the Division, EFCI has enclosed a copy of a letter received from the <br />Rock & Rail, LLC railroad company, owner /operators of the site, stating that they have no plans to <br />disturb the area of the relocated RA as depicted on the EFCI's referenced map during the following time <br />period through years of 2015 — 2016. Prior to the close of this time period (2015 - 2016), it is EFCI's <br />intent to acquire final bond release and release of liability for the Loadout site. <br />If you have questions or require further information, please contact me. <br />
