COLORADO Division of Reclamation, ® A7 Mining and Safety Department of Natural Resources 1313 Sherman Street, Room 215 Denver, CO 80203 April 30, 2014 Mark Krivanek 101 F Street Salida, CO 81201 RE: Chip n Dale; DRMS File No. M- 2014 -017; Second Notice of Incompleteness Dear Mr. Krivanek, On April 4, 2014, the Division of Reclamation, Mining and Safety (Division) received your 1 10(2) Hard Rock Reclamation Permit Application package for the Chip n Dale site, File No. M- 2014 -017. Preliminary review of the information received determined that the following items must be received before the Division can consider your application as being submitted and technical review can begin: 6.3.9 Exhibit I — Proof of Filing with County Clerk The proof of filing with the Chaffee County Clerk and Recorder which was submitted to the Division on April 29, 2014 does not satisfy the requirements of Rule 6.3.9. The document which you filed with the County Clerk and Recorder pertained to your BLM claim information. Pursuant to Rule 6.3.9, you must file a copy of the 110(2) Hard Rock Reclamation Permit Application package which you submitted to the Division. In addition, you may omit any information supplied in the application disclosing the location, size, or nature of the deposit or depth of thickness of the ore body or deposit per Rule 1.3(3). You must notify the Division in writing and specify which portions of the application you wish to keep confidential. Your application will not be considered filed until the information listed above is received and found sufficient to begin our review. A decision date will be established 30 days from the date of receipt of all of the requested information. Additionally, if you have already published notice you will need to republish notice, after the Division considers the application submitted. Republication must occur once within ten (10) days of the submittal date. We will notify you when you should initiate republication of your notice. The final date for receiving comments is ten (10) days after the date of publication or the next regular business day. You have until June 17, 2014 to submit all necessary documents that the Office needs for an application to be considered filed.
