No representative of New Elk Coal Company (NECC) was present. The weather was overcast and <br />showery. Several significant snow and rain storms had occured in the preceding week. One permitting action is in <br />progress and is detailed under the heading GENERAL MINE PLAN COMPLIANCE. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />The records were maintained in the Technical Services office at the New Elk mine. Detailed comments are <br />made at the end of this report. <br />HYDROLOGIC BALANCE - Rule 4.05 <br />Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, 4.05.10; <br />Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water Monitoring 4.05.13; <br />Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The two rows of straw bales were in position on the northern edge of the site. There was no sign of active <br />erosion. <br />GENERAL MINE PLAN COMPLIANCE: <br />An application for Permit Renewal (RN6) was received on December 19, 2013. The Division found the <br />application complete on December 23, 2013. An initial adequacy review was sent to NECC on February 21, 2014. <br />The response from NECC was received by the Division on April 21, 2014 but has not yet been reviewed.
