Leigh Simmons
Division Reclamation Mining and Safety
April 28, 2014
Page 2
As a result of NOV CV 2013 -09, the east sloping portion Clean Water Diversion Ditch
D -55 was regraded to insure positive drainage throughout that segment of the ditch.
After several attempts, and several surveys, this task was completed. The as -built
surveyed plan and profile drawings, certified by Registered Professional Engineer
Charles W. McGlothlin, provide the survey results for both East and West Segments of
the Diversion Ditch and the average grade along each subsegment of the ditch. The field
survey verified that the ditch provides continuous positive drainage and was cut entirely
into bedrock, thus not requiring riprap.
The plan and profile drawings were provided to Mr. Jim Stover, a Registered
Professional Engineer, to certify that the as constructed design would in fact meet the
diversion requirements of a 100 - year /24 -hour storm event, as required for refuse disposal
areas. His certified analysis to be added to Exhibit 19 of the permit is enclosed.
Enclosed with this submittal are three copies of the certified plan and profile views of D-
55 to be added to Exhibit 20 and three copies of the new design criteria to be added to
Exhibit D -19. Section 2.05 Table 20 will be revised to show the new design criteria for
D -55. This revision will be emailed to DRMS, attention Leigh Simmons, Tuesday April
29'.
Best Regards,
Ron Thompson
Agent
New Elk Coal Company LLC
