PERMIT #: M- 2002 -020 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: April 7, 2014 <br />OBSERVATIONS <br />The 25th Avenue Site was inspected by Peter Hays and Tom Kaldenbach with the Division of Reclamation, <br />Mining and Safety (Division) in response to a citizen complaint (CT -02) received on March 25, 2014 from <br />Roxanne Prather on behalf of her father William Rodman. <br />The Rodman property is located at 3613 F Street in Greeley, Colorado. The property is located southwest of <br />the 25th Avenue Site operated by the City of Greeley (City). <br />The Division met with Mr. and Mrs. Rodman, Ms. Prather and Ms. Uhland on the Rodman's property prior to <br />the inspection of the 25th Avenue Site. The reason for the second complaint by the Rodmans was in regard to <br />the City's long -term mitigation plan as stated in the proposed agreement between the parties dated <br />December 3, 2013. The City is proposing to install a 4 inch diameter waterline with a 1 inch diameter <br />waterline tap. The 1 inch diameter waterline would provide domestic water to the Rodman's residence at a <br />rate of 17 GPM. Additionally, the City would install a 5,000 gallon underground cistern which would be <br />connected to the two existing groundwater wells on the property. The groundwater wells and cistern would <br />be used for irrigation purposes only. <br />By signing the agreement, the Rodmans would release the City from liability for any groundwater impacts <br />following the conclusion of mining or completion of the planned slurry wall at the site. The Rodmans are <br />concerned the amount of groundwater in their wells will be reduced following the completion of mining and <br />prior to signing the agreement are requesting assurance of restored historical groundwater capacities. The <br />City is requiring the agreement to be signed by the Rodmans before installing the waterline. <br />Two geotechnical borings were completed by the City to verify the alluvium depth and depth to bedrock since <br />the Division last inspection. The depth to bedrock on the Rodman's property was confirmed to be <br />approximately 30 feet. The verification of depth eliminated the possibility of the City installing a deeper well <br />to address any current or future groundwater impacts caused by the mine dewatering. <br />A meeting between the Rodmans and the City was scheduled for Tuesday April 8, 2014 to determine the <br />waterline installation timing and cistern size. The Division is not aware of the outcome of the meeting. <br />The Division met with Mr. Eric Reckentine and Mr. Jim Hall with the City of Greeley and Mr. William <br />Schenderlein with Blue Earth, consultant to the City of Greeley, to discuss the citizen complaint at the mine <br />site. The site was active during the inspection. The southwest mining cell was actively dewatering. The <br />estimated depth of the southwest mining cell increased from 30 feet to 45 feet since the last inspection. <br />The Division contacted the Division of Water Resources (DWR) to discuss the Rodman wells and water rights. <br />The DWR confirmed the Rodmans own one share of Greeley Ditch #3 water with Well Number 3597 -F -R listed <br />as an alternate diversion point for the water share. The enforcement of the water right is not in the Division's <br />jurisdiction and may require the Rodmans to pursue the matter in civil court. <br />Conclusion <br />The Division believes the Operator is fulfilling the requirements of Rule 3.1.6 regarding disturbances to the <br />prevailing hydrologic balance for the surrounding area to the quantity of water in the groundwater system <br />during the mining operation by implementing the completed and proposed mitigation measures for the <br />Page 2 of 4 <br />
