The Division also received comments from the U.S. Army Corps of Engineers (USACE). It
appears that the proposed installation of flumes in West Terror Creek would require a
Department of the Army permit. USACE indicated that it is likely that the work would
qualify for Nationwide General Permit (NWP) number 5 for Scientific Measuring Devices.
Please either provide a copy of the required USACE permit, or documentation from USACE
that a permit will not be required. If the permit is required and obtained, reference to the
permit should be made on page 2.05 -133, and the permit should be included in Exhibit 8 of
Volume 111 of the permit application package.
3. BRL provided Right of Entry information from the USDA Forest Service (USFS) in the form of
an email from the USFS to BRL acknowledging BRL's intent to install the flumes. The email
requests that BRL ensure that the flumes do not reduce flow to interfere with upstream fish
migration, and that BRL provide the location(s) and dimensions of the flumes. Has BRL
provided this information to USFS?
4. Prior to the submittal of the MR150 application, BRL provided DRMS with a photo- diagram
of a typical installation, which was not subsequently included in the revision application.
Please submit a diagram of the proposed flume(s) for inclusion in the permit application
package.
