4/24/2014 State.co.us Executive Branch Mail - Bowie No. 2 TR -77 - Topsoil Balance on Gob Piles
Burgmaier - DNR, Susan <susan.burgmaier @state.co.us> Wed, Apr 23, 2014 at 10:53 AM
To: Jared Ebert - DNR <jared.ebert @state.co.us>
Cc: Sandy Brown - DNR <Sandy.Brown @state.co.us >, Alysha Hernandez - DNR <alysha.hernandez @state.co.us>
Jared - Bowie Resources, LLC (BRL) has responded to our adequacy concerns with their TR77 application.
To refresh your memory, this TR was originally submitted as a request for approval to substitute cover material for
topsoil, to address a deficit of available topsoil material. During the review process, BRL removed the request to
substitute cover material for topsoil, and instead provided a material balance update to demonstrate that the
entire refuse area disturbance would be covered with less topsoil than originally proposed and approved.
For Gob Piles 41, #2, and #4 the currently approved topsoil redistribution depth is 0.9; the proposed replacement
depth with TR77 will be 0.5'. Gob Pile #3 is currently approved to be covered with 2.4' of topsoil; the proposed
replacement depth with TR77 is 1.5'.
The proposed replacement depth for Gob Piles #1, #2, and #4 is based on the available material in stockpiles D
and E, which were both surveyed this month. The proposed replacement depth for Gob Pile #3 is based on the
April survey and an estimate of remaining topsoil to be salvaged under the west cover fill stockpile.
Will you please review the current proposal to determine whether it meets the requirements of Rule 4.06.4(2) for
topsoil redistribution? All of the correspondence is available in laserfiche. Copies of the proposed maps and
application pages are in my TR77 file in my office. If at all possible, I would appreciate having your comments by
May 14, 2014.
Susan L.
