April 22, 2014 <br />John Paul Ary <br />Fremont Paving and Ready Mix, Inc. <br />839 MacKenzie Avenue <br />PO Box 841 <br />Canon City, CO 81215 <br />RE: M- 2000 -041 AM -01 <br />Dear Mr. Ary, <br />RECEIVED <br />APR 23 2014 <br />DIVISION OF RECLAMATION <br />MINING AND SAFETY <br />We have reviewed your letter dated January 13, 2014 and have the following <br />comments: <br />Although the letter mentions your commitment to monitoring, you have not <br />defined any specific monitoring that will be performed. Your letter did not <br />mention or provide your proposed methods to mitigate depletions created by the <br />current mining operations in this area to our senior adjudicated wells. In addition, <br />we did not identify any defined mitigation for these depletions through our search <br />of the 112 permit on the DRMS website. <br />The groundwater resource is critical to Southwest Farms, Inc. and mitigation of impacts <br />and depletions to this resource from current and proposed future mining needs to be <br />resolved. Southwest Farms, Inc. requests that you provide the following for review and <br />concurrence by Southwest Farms, Inc. and that these issues be resolved before a <br />modification to the mining permit is approved: <br />• Details on the monitoring locations and on the methods that will be used to <br />monitor groundwater conditions. <br />• Details on the methods and locations for mitigation of current and future <br />groundwater depletions. <br />The methods and locations for monitoring and mitigation need to be included in the <br />application for amendment (AM-01) to M- 2000 -041 Evans Pit #2. It is important that the <br />monitoring and mitigation are clearly defined so that dewatering at the Evans Pit does <br />not continue to cause adverse imparts to Southwest Farms, Inc. <br />Also as requested I have assembled available data to illustrate the increasing impacts <br />to the aquifer blow Southwest Farms, Inc. from expansion of mining operations and <br />associated dewatering at the Evans Pit #2. However, the specific data that you <br />requested is not available. <br />
