Stover & Associates on behalf <br />of Bowie Resources, LLC (BRL), on March 19, 2014. The application was deemed complete for <br />purposes of filing on March 28, 2014. <br />Proof of publication for the applicant's Public Notice was received on April 17, 2014. The <br />notice appeared in the Delta County Independent on Wednesday, April 9, 2014, initiating a ten - <br />day period for public comment which extended through Monday, April 21, 2014. No comments <br />or objections to the TR-58 application were received. <br />With TR -58, BRL is seeking approval to remove the sediment ponds and alternate sediment <br />control structures at the West Mine and Timber Storage (a.k.a. Run- of-Mine or ROM) areas of <br />the Bowie No, 1 Mine. The application included revised pages 21 and 22 of Volume 1 Part 2.05; <br />a Soil Loss Comparison for insertion into Volume 8A; and a 2013 Vegetation Inventory, not <br />intended for insertion into the permit. <br />Sedimentation ponds for the mine are discussed in subsection 2.05.3(3) of the permit, beginning <br />on page 15. Pond designs and as -built plans are found in permit Volume 6 Phase III Stability <br />Analyses (OVWM Sheets 1 thru 10); Volume 8 (East Roatcap Creek Culvert -- Sheets 1 and 2) <br />and Volume 8A (Maps 8A -3, -16, -17, -18, and -19). <br />The Division has reviewed the application, and has the following adequacy comments. <br />1. BRL has provided soil loss comparison information for the West Mine and ROM areas <br />compared to pre -mine conditions. The comparison provided by BRL, a Revised <br />Universal Soil Loss Equation (RUBLE) calculation, concludes that reclaimed areas are <br />not contributing sediment in excess of pre -mine levels.
