M -1977 -248, M- 1977 -297, M- 1978 -311, and M- 1978 -342 <br />Dear Mr. Coram, <br />As you are aware, Gold Eagle Mining, Inc. (GEMI) and the Division of Reclamation, Mining and <br />Safety (Division) established a May 31, 2014 compliance deadline for completing the required <br />final reclamation of the four mines for which GEMI is the permittee: C -.ID -5 Mine, Burros Mine, <br />Ellison Mine and Hawkeye Mine, permit numbers are referenced above. <br />In December of 2013, the Division approved a technical revision for each permit that revised the <br />mine's reclamation plan. As noted in the Division's approval letters, the U.S. Department of <br />Energy (DOE) is the primary oversight agency for each of the four mines, and GEMI must submit <br />the Division - approved reclamation plans to DOE for approval. Based on correspondence dated <br />September 26, 2013, from DOE received by the Division, the Division understands that GEMI <br />submitted the technical revisions to DOE for approval. DOE's letter also stated that the federal <br />District Court issued an injunction enjoining DOE from approving any activities, including <br />reclamation. <br />At this time, the Division has not received notification that DOE has approved the reclamation <br />plans; that GEMI has commenced reclamation; or that the District Court dissolved the injunction. <br />Under these circumstances, the Division is concerned that GEMI will be unable to complete <br />reclamation of the four mines by the agreed -upon May 31, 2014 deadline. If GEMI anticipates it <br />cannot comply with the May 31, 2014 deadline, GEMI may file a Petition for Declaratory Order <br />requesting a hearing before the Mined Land Reclamation Board (Board) to extend the deadline. <br />Hard Rock Rule 2.5.2 contains the procedures for requesting a declaratory order, including the <br />deadline to submit a petition prior to the Board hearing. The Board considers such petitions <br />during its regular monthly meetings. The next Board meeting, with sufficient time to submit a <br />petition and have a hearing prior to the compliance deadline, is May 21 -22, 2014. <br />Failure to complete reclamation or obtain an extension from the Board before May 31, 2014, may <br />result in the Division bringing the possible violation before the Board for a formal hearing <br />regarding GEMI's noncompliance. <br />. cY•co�� <br />;o <br />1313 Sherman Street, Room 215, Denver, CO 80203 P 303.866.3567 F 303.832.8106 http: / /mining.state.co.us I q <br />John W.
