NR
COLORADO}
Division of Water Resources
Department of Natural Resources
1313 Sherman Street, Room 821
Denver, CO 80203
Response to Reclamation Permit Partial Acreage Release Request Consideration
DATE: April 16, 2014
TO: Elliott R. Russell, Environmental Protection Specialist
CC: Division 1 Office, District 64 Water Commissioner
FROM: Sarah Brucker, P.E.
RE: Riverside Pit, File No. M- 1976 -056
Operator: McAtee Construction Company
Contact: Darren Gebhart, (970) 521 -0651
Sections 28 St 33, Twp 8 North, Rng 52 West, 6th P.M., Logan County
COMMENTS: The applicant has requested a partial acreage release for the Riverside Pit (WDID 6403005).
The release concerns 22.72 acres located east of the Lowline Ditch in Section 28. The area remaining in
the permit boundary will be 63.63 acres.
The Riverside Pit is included in the Logan Well User's plan for augmentation, decreed in Division 1 Water
Court case no. 07CW0300. A gravel pit well permit (permit no. 66811 -F) has been obtained for the site.
On September 16, 2013 the South Platte River breached an unlined gravel pit pond within the subject
22.72 acres known as Lake Robert. According to the Applicant, the South Platte River has abandoned its
former river channel and now flows through what was formerly Lake Robert. The Applicant does not
intend to attempt to return the South Platte River to its original channel due to the expense and
complexity of such an undertaking. Since the 22.72 acres are now a river channel and its banks, the
Applicant is unable to complete reclamation of the site as proposed in their Reclamation Plan and
therefore requests that the area be released.
Based on the above, this office has no objection to the request for partial acreage release for the subject
22.72 acres being granted.
REMNIF.P
APP 1 7 2014
Division :t' V Iamatipr,
Mining 8: Safety
i OFIepC `\
1313 Sherman Street, Room 821, Denver, CO 80203 P 303.866.3581 F 555.555.5555 www.water.state.co.us
