Scott Cowman <br />Re: Notice to Proceed with Preliminary Studies and Transmission Facilities <br />Engineering Analysis for the proposed Peabody Energy Sage Creek Mine <br />Project (the "Project "), located near the existing Peabody Energy 20 Mile <br />Mine in Routt County, CO. <br />Dear Mr. Cowman, <br />Peabody Sage Creek Mining, LLC ( "Customer ") and Public Service Company of <br />Colorado, a Colorado corporation ( "Company ") (Company and Customer may be <br />referred to individually as "Party" or collectively as "Parties ") by execution of this <br />Notice to Proceed, authorize and direct the Parties to begin the Work as defined <br />below and for the Customer to provide financial security for the Work. <br />The "Work" includes all work and services to be performed by Company, <br />including but not limited to preliminary studies and transmission facilities <br />engineering analysis, to determine the potential effects from surface subsidence <br />above the Sage Creek mines on (i) the Company's Hayden - Foidel Creek 230kV <br />transmission line and (ii) Western Area Power Administration's (WAPA) Craig - <br />Ault 345kV line (the "Transmission Facility ") which is located on the same <br />transmission structures. Company is the maintenance agent of the WAPA lines <br />and structures and in that role is responsible for understanding the potential <br />effects from surface subsidence above the Sage Creek mines on the WAPA lines <br />also. The Work is limited to the area over and adjacent to mine panels 1S <br />through 5S. The Company will use available facility information and industry <br />engineering tools to determine whether the Transmission Facility can <br />accommodate the predicted subsidence. If the Transmission Facility is not able <br />to accommodate the predicted subsidence, the Company will determine what <br />mitigation, if any, can enable the Transmission Facility to accommodate the <br />predicted subsidence and the estimated mitigation costs. The Customer has <br />provided the predicted subsidence movements at the structure foundations. <br />Additional information may be requested by. the Company, as deemed necessary <br />and upon request for the same Customer shall provide Company with the <br />requested information in writing within ten (10) business days. <br />
