rose and spilled over the designed berm spillway, until it undercut the structure, the <br />weight of which simply fell into the waters and was pushed into the pit and covered by <br />flood born debris and related native berm materials. The residual bottom was not a <br />temporary berm as stated in the OMLR inspection report, but as identified properly <br />during the inspection, the underlying native materials of the native berm itself. Also <br />contrary to the OMLR statement that the operation allowed the water in, it is in fact <br />designed to purposefully direct flood flows into the basins. The only effect of the loss <br />of the sill was to dramatically drop flood flows in half for nearly a 12 hour period, to the <br />direct benefit of downstream users. The need to simply restore the spillway with earth <br />is that it is considerably more cost effective and beneficial to all to do so. <br />That the people responsible for creating the map are unconcerned by the proposal, we <br />understand that you would want those responsible for the enforcement of it to concur, <br />and as soon as that concurrence is met, we will forward it to the OMLR to conclude the <br />Technical Revision necessary to allow the repair to be completed according to the <br />specific requirements and limitations described in the A.C.E. correspondence. We <br />would hope to have this resolved and approved in time to prevent further intrusion into <br />our basin before spring flooding. <br />We trust our reply adequately addresses the concerns of the Office.
