DEPARTMENT OF NATURAL RESOURCES
DIVISION OF WATER RESOURCES
John W. Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director
e- 'kesponse to Reclamation Permit Conversion Application Consideration
DATE: March 31, 2014
TO: Elliott R. Russell, Environmental Protection Specialist
CC: Division 1 Office, District 64 Water Commissioner RECEIVED
FROM: Sarah Brucker, P.E.
RE: MMM Partnership Gravel Pit, File No. M- 2006 -04.2
MAR 3 1 i4
Operator: MMM Partnership Division of Rsc €aaiation,
Contact: Mark Kokes, (970) 867 -3624 Mining & Safety
Sec 34, Twp 12 North, Rng 49 West, 6th P.M., Logan County
CONDITIONS FOR APPROVAL
® The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground water
must not occur during or after mining operations.
® The applicant has not identified any proposed use of water at the permit site. If water will be used for any
purpose at this site, the applicant will need to document that the water was obtained from a legal source, or
the water was diverted in priority under a water right decreed for such industrial use.
COMMENTS: The application seeks to convert M- 2006 -042 from a 110(c) Limited Impact Construction Materials
Permit to a 112(c) Regular Construction Materials Permit. The application also seeks to add 17.9 acres to the
current 9.9 permitted acres, for a total permit area of 27.8 acres.
The primary commodities to be mined at the site are sand, gravel, and borrrow. The site is proposed to be
reclaimed to its current use of pastureland upon completion of mining operations.
If stormwater runoff is intercepted by this operation and is not diverted or captured in priority, it must be released to
the stream system within 72 hours, which may require a discharge permit from CDPHE -WQCD. Otherwise, the
operator will need to make replacements for evaporation.
The applicant may contact the State Engineer's Office with any questions.
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 - 866 -3581 • Fax: 303 - 866 -3589
www.watenstate.co.us
