Please confirm no explosives will be used in conjunction with the mining or reclamation. <br />6.4.5 Exhibit E - Reclamation Plan <br />15. The Applicant states the high walls will be laid back at a 3:1 back slope during reclamation. <br />Please provide additional details on how the final 3H:1V slope will be achieved by the <br />Applicant. <br />During the Pre - Operational inspection, the option of committing to mining the final slopes <br />at 3H:1V was discussed to reduce the amount to reclamation bond required for the site. <br />Please commit to mining the final slopes at 3H:1V if acceptable to the Applicant. <br />16. The Applicant states the maximum disturbed area at one time will be 10 acres. Please <br />explain this statement since 9.9 acres are currently disturbed and the reclamation plan <br />indicates Phases 1 and 2 will disturb at the same time totaling 17.07 acres. <br />17. Please provide a description of the type of reclamation the Applicant proposes to achieve in <br />the reclamation of the affected land. <br />18. Please provide a comparison of the proposed post- mining land use to the other land uses in <br />the vicinity and to adopted state and local land use plans and programs. <br />19. As required by Rule 6.2.1, all maps must be prepared and signed by a registered land <br />surveyor, professional engineer, or other qualified person. Please sign Exhibit E and all <br />other maps submitted for the conversion application. <br />20. During the Pre - Operational inspection, the Applicant stated the northern mining boundary <br />for four proposed mining phases would be the last to be mined in order to provide a visual <br />barrier. Please explain and provide additional detail on how the visual barrier will be <br />maintained and how it will be mined. <br />6.4.12 Exhibit L - Reclamation Costs <br />21. The Division will estimate the cost to reclaim the site based on the information submitted <br />once the Applicant addresses the concerns noted in this letter. <br />6.4.15 Exhibit O - Owner of Record of Affected Land and Owners of Substance to be Mined <br />22. Exhibit 0 states James E. Yust as the owner of record, however the lease agreement <br />submitted as the source of Legal Right to Enter indicates Yust Ranch as the owner and is <br />signed as San Toy Land Co. LLC / Yust Cattle CO. INC. Please clarify the owner of affected <br />and substance to be mined and revise Exhibits 0 - Owner of Record and Exhibit N - Source <br />of Legal Right to Enter accordingly. <br />
