Martin Marietta Materials <br />Rocky Mountain Division <br />1800 N Taft Hill Road <br />Fort Collins, CO 80521 <br />Telephone: (970) 407 -3600 <br />March 28, 2014 <br />Mr. Eric Scott <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />RE: M- 1979 -191, Follow up to inspection dated July 17, 2013 <br />Dear Mr. Scott: <br />Please accept this letter as our response to the problems noted in your recent report. <br />1) Permit amendment will need to be submitted within 6 months to change the post mining land use <br />to accommodate the change to lined water storage, and to revise the permit boundary to <br />incorporate all disturbances associated with mining activity. DRMS acknowledges that these <br />disturbances appear to be shown and approved on the 1979 mining plan; therefore the Division will <br />not pursue enforcement for area affected outside the permit at this time. <br />Please accept this letter as our request to extend this deadline to May 31, 2014. <br />After numerous meetings with the property owners, we have a reclamation plan that is <br />acceptable to the property owners and balances the material at the site so we don't have to <br />import or export any fill. The compacted liner has been designed and the mining and <br />reclamation plans are basically completed. We are asking for additional time to develop the <br />remaining exhibits (ground water monitoring and mitigation plan, new permanent manmade <br />structure agreements, stability analysis and any other remaining modifications). <br />Please give me a call at (970) 227 -4041 with any questions or concerns. <br />Sincerely, <br />J e Mikulas <br />Land Manager <br />
