Hickenlooper <br />March 27, 2014 Governor <br />Mike King <br />Kent Sterett Executive Director <br />8981 Kittiwake St. Loretta Pineda <br />Littleton, CO 80126 Director <br />RE: Capital Prize Mine; DRMS File No. P- 2014 -005; Clarification of Permitting <br />Requirements <br />Dear Mr. Sterett, <br />The Division of Reclamation, Mining and Safety (Division) is in receipt of your letter dated <br />March 21, 2014 in which you clarify your intent regarding the proposed activities at the Capital <br />Prize Mine in Georgetown, Colorado. The Division understands that your intent is to operate the <br />Capital Prize Mine as a tourist mine during the upcoming tourist season after prospecting <br />activities have been completed. The purpose of this letter is to clarify the process for issuing a <br />Notice of Intent to Conduct Prospecting Operations (NOI) and to make you aware of the time <br />required to issue and release an NOI. <br />Pursuant to Hard Rock Rule 5.13(a) and (c) review of the NOI application may take up to three <br />months to complete. The Division will approve the NOI if all deficiencies are addressed by the <br />decision date. Pursuant to Hard Rock Rule 5.1.3(d)(IV), the Division's decision will not take <br />effect until the expiration of five business days allowed for an appeal, or, in the case of an <br />appeal; until the Mined Land Reclamation Board issues its decision. In addition to the time <br />required to issue the NOI, additional time will be required to release the NOI from further <br />reclamation responsibility. Pursuant to Hard Rock Rule 5.3.5(1) and (2) it may take up to two <br />months to release the NOI. Furthermore, these timeframes do not take into account the time <br />required to conduct prospecting activities. <br />An NOI application for the Capital Prize Mine was submitted by Maisie Mining Company, LLC <br />on March 25, 2014. Review timeframes for issuing and releasing NOI's are variable and depend <br />on the nature of the prospecting activities. However, there is the potential it will take up to five <br />months, excluding the time it takes to conduct prospecting activities, to issue and release the NOI <br />for the Capital Prize Mine. <br />The Division would like to reiterate that tours at the Capital Prize Mine cannot be conducted as <br />long as there is an active NOI associated with the site. In addition, any review of safety <br />considerations for the tourist operation will not be reviewed by the Mine Safety Program until <br />the NOI has been fully reclaimed and released. <br />Office of <br />Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
