RULING OF REFEREE AND JUDGMENT AND DECREE
The above - captioned Application for Underground Water Rights and Request for
Approval of Plan for Augmentation was filed June 29, 2012, and was referred to the
undersigned as Water Referee for Water Division 4, State of Colorado, by the Water Judge
of said court, in accordance with Article 92 of Chapter 37, C.R.S., known as the Water Right
Determination and Administration Act of 1969.
The undersigned Referee, having made such investigations as are necessary to
determine whether or not the statements in the Application are true, having reviewed and
considered the Consultation Report/Recommendation filed by the Division Engineer for
Water Division 4, and having become fully advised with respect to the subject matter of the
Application, hereby enters and makes the following findings of fact, conclusions of law, and
ruling as referee in this matter:

1. The name and address of the Applicant is Gunnison Valley Properties, LLC,
864 West South Boulder Road, Suite 200, Louisville, Colorado 80027.
2. All notices as required by law of the filing of this Application have been
timely and adequately given. The time for filing Statements of Opposition has expired. The
fee for publication of the resume notice has been paid on behalf of the Applicant.
