PERMIT #: M- 2009 -018 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: March 14, 2014 <br />OBSERVATIONS <br />The Heintzelman Project was inspected by Peter Hays, Elliott Russell and Amy Eschberger with the Division of <br />Reclamation, Mining and Safety (Division) in response to a citizen complaint (CT -01) received on February 25, <br />2014 from Mr. Herbert Acord. <br />The Acord property, 7541 County Road 26 3/4, Longmont, CO 80504, is located approximately 1500 feet west <br />of the northwest boundary of the Heintzelman Project. Mr. Acord's letter states he has been experiencing <br />fluctuating well water levels since the mining operation began dewatering operations. Mr. Acord states the <br />hand dug water well, which was installed in 1946 to a depth of 16 feet below grade went dry in December. <br />Mr. Acord applied for a replacement well permit, #35646 -A, and installed the replacement well in December <br />2013. Mr. Acord stated the new well was supplying adequate water for domestic and livestock uses on his <br />property. Mr. Acord's letter also stated the natural spring which supplies water to wetland areas on his <br />property have also dried up over the last year. A copy of the complaint letter is attached. <br />The Division met with Mr. Acord on his property prior to the inspection of the Heintzelman Project. <br />Wells <br />The Division observed the old well vault, the new wellhead and a piezometer installed by Andesite Rock <br />Company during the meeting. The original well was permitted by the Colorado Division of Water Resources <br />(DWR), #35646, as a domestic well. The well was 21 feet deep with a static water level 9 feet below grade <br />based on DWR records. The replacement well, #35646 -A, was installed on December 12, 2013 to a depth of <br />30 feet below grade with an initial water level of 10 feet below grade and a static water level of 12 feet below <br />grade after a pump test based on DWR records. The original well was abandoned following the completion <br />the replacement well. The Division was unable to measure the depth to water in the new well or the <br />piezometer on the site. The piezometer casing was backed into and the pvc pipe was kinked at approximately <br />ground level. <br />Mr. Acord stated in his letter the original well depth was 16 feet below grade. The Well Inspection Record <br />report from AWES, LLC dated December 9, 2013 states at the time of the AWES inspection the well depth was <br />approximately 12 feet below grade with a depth to water of 10.5 feet below grade. <br />Wetland-, <br />The wetland ponds located northeast of the Acord property buildings were observed during the meeting. The <br />ponds were mostly dry with only small areas of water observed. The wetland ponds depth from ground level <br />was estimated by the Division to range between 3 to 5 feet deep. An Army Corps of Engineers permit for the <br />wetland ponds could not be located by the Division following the inspection. <br />Heintzelman Protect <br />The Division met with Brad Janes with Varra Companies, Inc. and Joby Adams with AWES, LLC to discuss the <br />citizen complaint following the meeting with Mr. Acord. <br />The mine site was actively mining during the inspection and dewatering operations were observed. The pit is <br />excavated to approximately 30 feet below grade. The dewatering trench elevation was estimated at 30 feet. <br />The pit is planned to mine to bedrock which is located approximately 47 feet below grade. <br />Page 2 of 5 <br />
