Pineda <br />Director <br />The Division received your application and proposed publication for Peabody Sage Creek <br />Mining LLC's application for Permit Revision No. 1 on March 4, 2014. Our initial review <br />indicated that all preliminary items required by Rule 2.08.4(5) had not been submitted. An <br />initial incompleteness letter dated March 14, 2014 was sent. Peabody Sage Creek Mining, <br />LLC responded via email on March 14, 2014. Based on further review of the PR -1 <br />application the application is incomplete for the purposes of filing as of March 24, 2014. <br />Items required determining the application complete: <br />Division initial comment: Please provide a revised Proposed Public Notice that <br />includes the following: <br />• The public notice shall include a concise statement describing the <br />particular portion of the road which is located within 100 feet, measured <br />horizontally, of the affected area. <br />• The public notice does not include a statement that a copy of the Permit <br />Revision will be on file at the Hayden Public Library during the public <br />review process as per PAP page, 2.03 -21. <br />Peabody Sage Creek Mining, LLC response: A revised proposed public notice <br />was submitted as required per Rule 2.07.3. <br />Office of Office of <br />Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines <br />
