Permit Amendment — Cemex Sandstone Quarry <br />the part of Cemex and DRMS where there was misunderstanding as to the exact location of the affected <br />lands boundary on the ground. <br />Using current GIS mapping technology (ArcView 10.1), the maps from TR1 were scanned, georeferenced <br />and overlaid with current topography and aerial photography to attempt to clarify the affected land boundary. <br />The northeast property corner was used to georectify the TR1 map and four shared topographical reference <br />points from the TR1 PDF and a 2013 digital elevation model (DEM) were used for scaling. The boundaries <br />drawn on the TR1 map were then digitized for comparison to current topography and aerial photography. <br />Figure A -2 shows the TR1 map overlaid with current topography and reference points. Figure A -3 shows <br />the digitized boundaries from TR1 on current aerial photography. This exercise illustrated that the 1997 <br />affected area boundary on the TR1 maps as well as the 1997 pit boundary do not line up with where they <br />would have been at that time, nor do they line up with the current disturbance boundary. <br />While the maps in TR1 were difficult to use in the field, Cemex has consistently maintained the commitments <br />made in the text of TR1 stating a total affected area not to exceed 9.99 acres and a total pit area of 6.5 <br />acres. Cemex is submitting this permit amendment to clarify the affected area boundary to match actual <br />current ground conditions without changing the commitment to an affected area not exceeding 9.99 acres. <br />This clarified affected lands boundary is shown in all figures included with this amendment application. <br />1. 1.2 Post - Mining Land Use Modification <br />When the original permit application was approved in 1978, Wildlife Habitat was not an option for post - <br />mining land use. At that time the Agricultural post- mining land use, specifically rangeland for livestock, was <br />the option best suited this area. Given the expanded post- mining land use options now available and the <br />current wildlife habitat use of the majority of the adjacent lands, Cemex seeks to modify the post- mining <br />land use to the Wildlife Habitat designation with this permit amendment. Cemex will also update the <br />reclamation plan to include native, location- appropriate species that will attract wildlife use. <br />1. 1.3 Mining and Reclamation Plan Updates <br />While the basic mining and reclamation plans submitted with the original permit application met all <br />requirements at that time, the current rules require more detailed information. In this permit amendment, <br />the Mining Plan will be updated to reflect current practices and technologies and specify a life -of -mine <br />strategy for mining. The Reclamation Plan will be updated to correspond to the updated Mining Plan, the <br />modified post- mining land use, and will include details of reclamation strategies not included in the original <br />1977 permit application. This amendment also includes updated, georeferenced maps detailing the mining <br />and reclamation plans to address the clarified affected land boundary. <br />1.2 Organization of Permit Amendment Application <br />This permit amendment application is organized according to the application requirements of the <br />Construction Materials Mineral Rules and Regulations ( CMMRR) § §1.11, 6.3, and 6.5. As provided by <br />§1.11(3), this application is not required to duplicate information presented in previous submittals; however, <br />most exhibits, including the Mining Plan (Exhibit C), the Reclamation Plan (Exhibits D) have been updated <br />to incorporate information presented in previous submittals as well as addressing current practices and <br />future plans. The Exhibits submitted with this amendment application supersede prior Cemex submittals <br />and are intended to present the most current information and plans. Technical information presented in <br />previous submittals and not duplicated herein, is incorporated by reference and remains part of the permit <br />record. <br />New or updated information is included with the following permit amendment exhibits: <br />• Exhibit A presents a legal description of the affected land, and a map of the affected land boundary <br />in accordance with requirements of CMMRR §6.4.1; <br />• Exhibit B presents an updated site description including vegetation, soils, wildlife, and water; <br />• Exhibit C presents an updated Mining Plan consistent with the current conditions; <br />• Exhibit D presents the revised reclamation plan consistent with current mine plans as well as <br />updated reclamation cost estimates; <br />Introduction 2 March 2014 <br />
