Diversion Ditches Permit C -1996 -083 Dear Ms. Burgmaier: On behalf of Bowie Resources, LLC, (BRL), enclosed is an application for a technical revision to expand Pond D and to relocate the East and West Diversion ditches higher on the slope above gob pile #2. The expansion of Pond D will allow the runoff from Gob Piles 2/4 to be divided between Ponds D and F. Pond D will increase in available storage from 0.89 acre -feet to 1.85 acre -feet. The storage volume required for Pond D is 1.07 acre -feet. The expansion of Pond D will involve relocating or removing culverts and other hydrology structures, installing new culverts, and demolishing the old Coal Sales houses currently located in the material storage area. Documentation of the Coal Sales house is provided in Volume VI by report dated September 15, 1996. No new disturbance will be created with the Pond D expansion, however, the disturbed area boundary shown on Map -18 does not reflect what is currently disturbed in the material storage area. In the future revision, the disturbed area boundary will be revised on Map -18 to accurately reflect what is disturbed on the ground. The work at Pond D will involve relocating the Pond C discharge valve structure (no change in bond), removal of three culverts (C -G2, C-F4 & one un- named, bond credit), re- installing and re- setting the elevation of one culvert (C -D1, no change in bond), installing two new culverts (C -G5 & C -G6 increase in bond), and installing a concrete box outlet structure (increase in bond). Please see the attached reclamation estimate. The East and West Diversion ditches will be relocated higher up on the hillside which will allow for more gob storage. An application for an increase in the height of gob pile #2 will be submitted under a separate technical revision application, along with a SedCad analysis, and applicable maps. It is anticipated that the future technical revision application will include text updates in Volume IX, Appendix B, and Figures 1-3. Also included will be Volume II, Maps 15 -1 & 3, 18, 20, 21 -1 & 3 and 32.
