Pineda Director The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on March 20, 2014, an application to revise coal mining operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. Bowie Resources, LLC (BRL) is proposing to incorporate the Spruce Stomp Federal Coal Lease (COC- 75916) into the permit area. The federal coal lease addition will allow BRL to mine eight additional longwall panels north of the existing mine area. The permit area will be increased by 1,790.2 acres. The affected area (lands overlying mine workings) will be increased by 1,356.3 acres. BRL is not proposing additional surface disturbance with this revision application. The Underground coal mining operation is on land located approximately 5 miles Northeast of Paonia, Colorado. The permit area is further described as follows: Portions of Sections 2, 3, 4, 5, 8, 9, 10, 11, 14, 15, 16, and 22, Township 13 South, Range 91 West of the 6th P.M. Portions of Sections 33 and 34, Township 12 South, Range 91 West of the 6th P.M. The above - mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle map(s): Bowie. The Division has interpreted 30 CFR 746.18 to determine that this application as submitted constitutes a Mining Plan Action, and has directed the operator to send a copy of the application materials directly to OSM. In order for us to comply with regulatory time frames, we request that any adequacy comments be submitted to Susan Burgmaier, Division of Reclamation, Mining and Safety, at the above address by 5:00 p.m. on May 14, 2014.
