The provisions of Section 37 -90- 137(2), C.R.S., prohibit <br />the issuance of a permit for a well to be located within 600 feet of any existing well, unless <br />the State Engineer finds that circumstances so warrant after a hearing held in accordance <br />with the procedural rules in 2CCR402 -5. This hearing may be waived if you are able to <br />obtain statements from the owners of all wells within 600 feet, verifying that they have no <br />objection to your use of the well. Should a new well permit be denied for reasons of 600 <br />foot spacing, or any other legitimate reason, approval of this SWSP may be cancelled. <br />3. The name, address, and phone number of a contact person who will be responsible for <br />the operation and accounting of this SWSP must be provided to the SEO, the Division 5 <br />Office (Steve Pope, Augmentation Plan Coordinator, steve.pope @state.co.us, <br />telephone 970 - 945 - 5665), and the water commissioner (Troy Wineland, <br />troy.wineland @state.co.us, telephone 970 - 355 -4516) within 20 days of the receipt of <br />this approval. <br />4. The total surface area of the ground water exposed at the Maryland Creek Ranch Pit must <br />not exceed 30.7 acres, which results in a maximum evaporative loss of 53.12 acre -feet per <br />year. <br />5. The annual water used for operational purposes at the Maryland Creek Ranch Pit shall not <br />exceed the following amounts: <br />• 8.8 acre -feet per year for dust control <br />• 8.6 acre -feet of water lost in the mined aggregate (292,000 tons) for 2013, <br />• 8.7 acre -feet of water lost in the mined aggregate (298,000 tons) for 2014 <br />• 4.8 acre -feet of water used for concrete production (51,900 cubic yard) for 2013 <br />• 4.9 acre -feet of water used for concrete production (52,900 cubic yard) for 2014 <br />• 0.39 acre -feet for 2013 and 0.40 acre -feet for 2014 for water used for concrete <br />truck washing <br />• 1.07 acre -feet of water use for asphalt production (116,210 tons) for 2013 <br />• 1.09 acre -feet of water use for asphalt production (118,534 tons) for 2014 <br />• 0.09 acre -feet per year for drinking and sanitary facilities <br />0.19 acre -feet for vehicle washing <br />• 0.8 acre -feet per year for landscape irrigation <br />6. Total consumption at the Maryland Creek Ranch Pit must not exceed these <br />aforementioned amounts unless an amendment is made to this SWSP. <br />7. Ice cover was assumed for the months of December through March; therefore no <br />evaporative consumptive use was assumed for those months. For the purposes of this <br />SWSP, the Applicant shall replace the net evaporative depletions from the exposed <br />ground water surface area that may occur during the assumed ice cover period <br />(December through March) for any time that the pits are not completely covered by ice. <br />8. Approval of this SWSP is for the purposes as stated herein. This office must first approve <br />any additional uses for which the water may be used. Any future additional historical <br />consumptive use credit given (e.g., agricultural water transfer) for this site must consider <br />all previous credits given. <br />9. All pumping for dust control shall be measured in a manner acceptable to the division <br />engineer. <br />
