Hickenlooper
Governor
Mike King
Executive Director
Dick Wolfe, P.E.
Director /State Engineer
RECEIVE
MAR 19 201+
Division of Redamatin,
Mining & Safety
We have reviewed your letter of May 8, 2013 and the additional information submitted on
October 14, 2013, requesting a renewal of the substitute water supply plan ( "SWSP ") on behalf of
Everist Materials, LLC ( "Everist" or "Applicant') for the Maryland Creek Ranch ( "MCR ") aggregate
operation in accordance with § 37 -90- 137(11), C.R.S. The mine is permitted with the Division of
Reclamation, Mining, and Safety ( "DRMS ") under File No. M -96 -049. The required fee for the
substitute water supply plan was submitted under Receipt No. 3659919. The original plan was
approved on April 3, 1997 and it was most recently renewed on July 30, 2009.
SWSP Operations
The MCR aggregate operation is located on the west bank of the Blue River,
approximately 6 miles downstream of Dillon Reservoir and 20 miles upstream of Green Mountain
Reservoir. Gravel mining operations take place at an elevation of approximately 8,550 feet, within
a distance of 2,200 feet of the Blue River, in Sections 15, 22 and 23, all in Township 4 South,
Range 78 West of the 6th P.M., as shown on the attached Figure A -3. Mining operations at MCR
include gravel mining from wet pits, a crusher and wash plant, an asphalt plant, and a concrete
batch plant. Product below the ground water table will be removed via "wet mining" techniques,
therefore dewatering of the pits will not occur, and is not approved herein. Under the DRMS
permit, Everist received approval to mine a total of 6 mining cells. Mining operations in cells nos.
1, 2 and 3 were finished and the surface area of ground water exposed in these three cells totals
approximately 26.9 acres. Mining is currently taking place in cell no. 4 where the surface area of
the exposed ground water at the end of 2013 was estimated to be approximately 3.8 acres. The
total surface area of ground water exposed in the cells 1 through 4 is estimated to be 30.7 acres.
No change in the ground water exposed surface area is expected to occur during 2014.
Replacement water is to be provided using consumptive use credits from dry-up of historically
irrigated land and releases of storage water from Green Mountain Reservoir and Dillon Reservoir.
In accordance with the letter dated April 30, 2010 (copy attached) from the
Colorado Division of Reclamation, Mining, and Safety ( "DRMS "), all sand and gravel
Office of the State Engineer
1313 Sherman Street, Suite 818 • Denver, CO 80203 • Phone: 303 -866 -3581 • Fax: 303 -866 -3589
www.watenstate.co.us
